1. Definitions

Terms used in the regulations, unless otherwise stated, mean:

  5. Entrepreneur – a person concluding a contract with com (making purchases in the online store) as part of business or professional activity;

  7. Commodity – item offered for sale by Choppertrippin.com;

  9. The order form– form available at web page, through which orders for goods are made;
  10. Account – functionality that facilitates the use of the online store;
  11. Working day–one day from Monday to Friday , with the exception of public holidays;
  12. Regulations – these regulations, in the field of services provided electronically. Regulations are regulations within the meaning of the Act from 18 july 2002r. on the provision of electronic services (Journal of Laws from 2013 item 1422 with amendments.) and defines the rules for the provision of services through the Store;

  14. Civil code – the Act of 23 April 1964, the Civil Code of Polish Law;
  15. Law– Act of May 30, 2014 on consumer rights of Polish law.

2. Application of the provisions of the Regulations

  1. The Regulations apply to contracts concluded with Users via the Online Store.

3. Basic information

  1.   2. Customers of the Online Store may be both Consumers and Entrepreneurs who have accepted the Regulations and comply with its provisions.

4. Goods and price

The Seller publishes information on the essential properties of the Goods and their price on the Website. The information on the Goods and their prices presented on the website apply only to the Online Store.

  1. All prices quoted in the Online Store are gross prices, expressed in euro (EUR) and PLN. The seller is a VAT payer, which amounts to 23%.

5. Registration in the Store

  3. After completing the form, the Customer receives confirmation of registration to the e-mail address provided. At this moment, the account is active.
  4. The creation and maintenance of an Account is free of charge. The Customer may resign from having an Account in the Store at any time and request its removal.
  5. In order to cancel the Account, please contact the Seller by e-mail, and the removal of the Account takes place immediately and is tantamount to the termination of the contract for the provision of electronic services for maintaining the Customer’s account.
  6. Through the Account, it is possible to: place and modify orders, view the order history or use other options dedicated to registered customers.

6. Product order

  1. The order is placed via the website of the Online Store by completing the Order Form available on the website. Placing an order is possible without the need to create an account in the Store, with the proviso that you cannot place an order anonymously or under a pseudonym.
  2. A natural person placing an order must be at least 18 years of age and have full legal capacity. In the case of minors, the consent of a parent or legal guardian is required.
  3. In the case of concluding a distance contract (via the Online Store), information about the Goods in the Online Store, including their descriptions and prices constitute only an invitation to conclude a sales contract within the meaning of art. 71 of the Polish Civil Code, in accordance with the terms of the Regulations.
  4. The order placement procedure consists in particular of:

  6. providing the Customer’s data necessary to perform the contract;
  7. designation of the delivery address;
  8. choosing the method of confirming the transaction (receipt, invoice);
  9. choosing the payment method;
  10. accepting these Regulations;
  11. consent to the processing of personal data;
  12. clicking on the button in the Online Store “Confirm Purchase” or with equivalent content.
  13. The order is placed by filling out the Order Form and providing the necessary data for the proper performance of the order (e.g. name, surname, address, e-mail address).
  14. The use of the Order Form begins when the Customer adds the first Good to the electronic basket in the Online Store. Placing an order takes place by performing two actions by the Customer: filling in the Order Form and clicking the “Confirm Purchase” button in the Online Store or another equivalent. At the same time, it is possible to modify the entered data on your own (to do this, follow the instructions displayed on the website).
  15. After placing the order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution and is processed. Confirmation of the order and its acceptance takes place by sending the Customer an appropriate e-mail to the address provided when placing the order, which contains at least the Seller’s declaration of receipt of the order and its acceptance for execution and confirmation of the conclusion of the sales contract..
  16. If the Customer is a Consumer, the Seller shall provide the Consumer with the information referred to in Art. 12 sec. 1 of the Act. The fulfillment of this obligation takes place by familiarizing the Consumer with the content of these Regulations before placing the order.

7. Supply of goods

  1. The Goods are delivered all over the world.
  2. The delivery is payable, unless the contract provides otherwise. Delivery costs are determined in accordance with 4 para. 3 of the Regulations.

  4. postal item via Poczta Polska and foreign postal operators, from Monday to Friday;
  5. courier shipment via DHL.
  6. The date of delivery of the Goods to the Customer is up to 31 Business Days from the moment the order is placed by the Customer (in practice, up to 16 days). In the case of ordering Goods with a different delivery date, the delivery date is the longest, but it may not exceed 31 Business Days. The start of the delivery period to the customer is counted as follows:
  7. in the event of payment by the Stripe system – from the date of crediting the Seller’s bank account or settlement account.
  8. Orders are processed through Poczta Polska and foreign postal operators and the courier company DHL and are delivered only on business days.
  9.   10. When collecting the parcel, in the presence of the courier, special attention should be paid to its condition and content.

8. Payment

  1. The Seller offers the Customer the following payment methods:

  3. The customer is obliged to make the payment within 7 calendar days from the date of the contract.

9. Compliance of the Goods with the contract and complaints

  1. The Seller is liable under the warranty for physical defects consisting in the non-compliance of the Goods with the contract, which existed at the time the danger passed on to the buyer or resulted from the cause of the sold item..
  2. In the event of a claim under the warranty and the compliance of the Goods with the contract, the purchased Goods should be sent back to the address for delivery along with a description of the complaint. If possible, please attach your proof of purchase. The proof of purchase will facilitate the recognition of the complaint, but it is not a necessary requirement for its consideration.
  3. After receiving the complaint and the advertised Goods, the Store will consider the complaint within 14 days and send the Customer a reply to the postal address or e-mail address provided by him. Failure to respond to the submitted complaint within 14 days shall be deemed to have been accepted. In order to meet the deadline, it is necessary to inform the customer within this period about the method of considering the complaint. If the complaint is accepted, it will be processed within 14 days from the decision on its legitimacy.
  4. The guarantee is granted only if a guarantee document has been issued with the release of the Goods and only under the conditions specified in this document.. 

10. Withdrawal from the contract

  1. The customer is not entitled to withdraw from a distance contract in the following situations:
  2. when the subject of the order were sound or visual recordings and computer programs stored on carriers after they were opened by the Consumer
  3. when the subject of the contract were goods that perish quickly or have a short shelf-life;
  4. when the subject of the order is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if the packaging has been opened after delivery to the Consumer;
  5. when the subject is a non-prefabricated item, manufactured according to the Consumer’s specification or serving to satisfy his individual needs.
  6. Apart from the cases referred to in sec. 1 above, the Customer who is a Consumer has the right to withdraw from the contract in the field of distance orders, without giving any reason, within 14 days from the date of delivery of the Goods.
  7. To meet the deadline, it is enough to send a declaration of withdrawal from the contract, an example of which is available at the bottom of the page, before the deadline specified in paragraph 1 above, to the address: Hot Creations Grzegorz Jakubczak, Kopydło 53/3, 43-460 Wisła. POLAND.

  9. The Consumer is obliged to bear the costs of returning the Goods to the Seller on their own.
  10. The right to withdraw from a contract concluded outside the business premises or at a distance is not entitled to the Consumer in relation to contracts where the subject of the service is a non-prefabricated item, manufactured according to the Consumer’s specification or serving to satisfy his individual needs.
  11. The store informs the consumer that it is not a party to the code of good practice.

11. Personal data protection 

  1. The administrator of your personal data is the Seller.

  6. in order to implement the legitimate interests of the Administrator, including to protect against possible claims or pursue possible claims (Article 6 (1) (f) of the GDPR);
  7. for the marketing of own services, provided that consent has been given (Article 6 (1) (f) of the GDPR).

14. Final Provisions

  5. None of the provisions of the Regulations limits the consumer’s rights under the provisions of applicable law in the territory of the Republic of Poland. In the event of establishing the existence of a provision violating these rights, the provisions of the law in force in the territory of the Republic of Poland, in particular the Civil Code and the Act of 30/05/2014 on Consumer Rights (Journal of Laws of 2014, item 827) shall apply.
